Terms of service

Draft. These terms are a reasonable starting point for a consumer iOS app with optional subscriptions and its marketing site. Review with legal counsel before relying on them.

These terms (the "Terms") govern your use of the Pupillary Distance iOS application (the "App") and the website at pupillarydistance.app (the "Site"), provided by Appcellent ("we", "us"). By installing or using the App or using the Site you agree to these Terms. If you do not agree, do not use them.

1. Not medical or professional advice

The App estimates your pupillary distance from your iPhone's TrueDepth camera. It is a convenience tool, not a medical device, and it does not provide an eye exam, prescription, or professional optical fitting.

Measurements can vary with lighting, distance, and how steadily you hold the phone, and an accurate PD does not guarantee a correct lens fit on its own. Before ordering prescription eyewear — especially progressive or high-prescription lenses — confirm your PD and prescription with a qualified optician or eye-care professional. You assume all risk associated with acting on information provided by the App.

2. License

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, and to view the Site. All intellectual property in the App and the Site remains ours or our licensors'.

3. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by applicable law.
  • Resell, sublicense, or distribute the App.
  • Use the App or Site to violate any law or infringe any right of a third party.
  • Interfere with or disrupt the integrity or performance of the App, Site, or any connected service.

4. Subscriptions and App Store terms

The App is free to download and try. PD measurement and frame recommendations require an auto-renewing subscription, offered on a weekly or yearly basis. Payment is charged to your Apple ID, and the subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID settings; deleting the App does not cancel it. Prices may vary by region and are shown in the App before purchase.

The App is distributed through Apple's App Store, and purchases are processed by Apple (entitlements are managed via RevenueCat). Apple's standard End User License Agreement also applies to your use of the App. If there is a conflict between these Terms and Apple's EULA, Apple's EULA governs only to the extent necessary to resolve that conflict.

5. Disclaimer of warranties

The App and the Site are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App or Site will be uninterrupted, error-free, or free from harmful components.

6. Limitation of liability

To the maximum extent permitted by applicable law, Appcellent and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the App or the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the App or the Site will not exceed the greater of the amount you paid for the App in the twelve months preceding the claim or USD 25.

7. Indemnification

You agree to indemnify and hold Appcellent harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the App or the Site.

8. Changes

We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date at the top of the page. Continued use of the App or Site after a change takes effect constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which Appcellent is established, without regard to conflict-of-laws principles. Mandatory consumer protections in your country of residence continue to apply.
